Privacy and compliance in Canada
- Ontario requires temporary help agencies and recruiters to hold a licence under the Employment Standards Act, and businesses may not knowingly use an unlicensed recruiter. Other provinces have their own rules for staffing and recruiting. Confirm with counsel.
- Candidate data, including background checks and credentials, is personal information under PIPEDA or provincial laws. Quebec Law 25 adds privacy impact assessment and consent duties, including for automated decision-making.
- Ontario pay transparency rules for job postings (in force from January 1, 2026) require posted compensation ranges, an AI-screening statement and vacancy disclosure. Software that publishes postings should support these fields. Confirm current requirements with counsel.
- Employment standards for temporary workers (pay, hours, records) are provincial; timesheet software should keep the records required.
